1. Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of the BikeCrew mobile application ("App," "Service," or "BikeCrew"). By creating an account or using BikeCrew, you agree to be bound by these Terms.
BikeCrew is the trade name of TK Systems, a sole proprietorship (eenmanszaak) registered in the Netherlands, located at Honthem 47, 6269NP Margraten, and registered with the Chamber of Commerce (Kamer van Koophandel) under number 99021811.
If you do not agree to these Terms, do not use BikeCrew.
BikeCrew reserves the right to change these Terms and Conditions. You agree that the most recent version of these Terms and Conditions shall apply at all times. These Terms and Conditions are available on https://bikecrew.app. On request, BikeCrew shall send these Terms and Conditions to you free of charge.
2. Applicability
These Terms and Conditions apply to every use of, access to, and interaction with the BikeCrew App and Service. By downloading, installing, or using the App, you accept these Terms in full.
Parties may only deviate from these Terms and Conditions by means of a separate written agreement. In the event of any conflict between these Terms and Conditions and provisions in a separate written agreement between you and BikeCrew, the provisions of that separate agreement shall prevail, unless explicitly stated otherwise.
3. Eligibility
To use BikeCrew, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
By creating an account, you represent and warrant that you meet these requirements. We reserve the right to request verification of your age at any time and to suspend or terminate accounts that do not meet our eligibility requirements.
4. Your Account
Account Creation
You are responsible for:
- Providing accurate and complete information when creating your account
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately if you suspect unauthorized access to your account
Account Security
You must not share your account credentials with others or allow others to access your account. BikeCrew is not liable for any loss or damage arising from your failure to protect your account information.
5. The BikeCrew Service
BikeCrew is a social platform for cyclists and motorcyclists. The Service allows you to:
- Discover riders in your area
- Create or join user-organized rides and group meetups
- Form or join crews (rider communities)
- Communicate with other users through messaging features
- View and create suggested riding routes
Nature of the Service
BikeCrew is a technology platform that facilitates connections between users. BikeCrew is not a tour operator, travel organizer, event organizer, transportation provider, or insurer. BikeCrew does not provide or arrange transportation services, guided tours, or organized events.
All rides, meetups, and activities are initiated, organized, and conducted solely by users. BikeCrew does not participate in, control, or assume responsibility for any such activities.
Routes and Navigation
Important: BikeCrew may display routes that are created manually by users or generated using algorithms and AI-based suggestions. You acknowledge and agree that:
- All routes displayed in BikeCrew are suggestions only
- Routes may be inaccurate, incomplete, outdated, or contain errors
- Routes may include roads that are closed, private, unpaved, hazardous, or otherwise unsuitable for cycling or motorcycling
- Routes may pass through areas where cycling or motorcycling is prohibited or restricted by law
- Routes may not account for current road conditions, weather, traffic, construction, or other hazards
- BikeCrew does not provide navigation services, traffic information, or safety guidance
- BikeCrew does not provide professional advice, safety guidance, or route certification of any kind.
You are solely responsible for:
- Evaluating the suitability and safety of any route before and during your ride
- Complying with all applicable traffic laws, regulations, and local rules
- Making your own decisions about where and how to ride
- Ensuring your route is legal and appropriate for your vehicle and skill level
BikeCrew strongly recommends that you always verify routes independently, use appropriate navigation tools, and exercise caution and good judgment while riding.
All use of the Service is at your own risk.
6. User Responsibilities
When using BikeCrew, you agree to:
- Comply with these Terms, our Privacy Policy, our Community Guidelines, and our Safety and Liability Disclaimer
- Use the Service only for lawful purposes
- Treat other users with respect
- Provide accurate information in your profile
- Not impersonate others or misrepresent your identity
- Take responsibility for your own safety during rides and meetups
- Follow all applicable laws and regulations when riding
- Provide BikeCrew with accurate and complete information where required
BikeCrew is not liable for any damages resulting from incorrect or incomplete information provided by you.
Assumption of Risk
You acknowledge that cycling and motorcycling involve inherent risks, including but not limited to accidents, injury, death, and property damage. By using the Service and participating in any rides or meetups, you voluntarily assume all such risks, whether known or unknown, and accept full responsibility for any consequences arising from your participation.
7. User-Generated Content
Your Content
You may post, upload, or share content through BikeCrew, including profile information, photos, messages, route suggestions, and other materials ("User Content"). You retain ownership of your User Content, but by posting it on BikeCrew, you grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, display, reproduce, modify, adapt, and distribute your User Content in connection with operating, promoting, and improving the Service.
You represent and warrant that:
- You own or have the necessary rights to share your User Content
- Your User Content does not infringe the rights of any third party
- Your User Content complies with these Terms and our Community Guidelines
Content Responsibility
You are solely responsible for your User Content. BikeCrew does not endorse, verify, or guarantee the accuracy of any User Content posted by users.
8. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Harass, threaten, abuse, or harm other users
- Post content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Share sexually explicit content or content depicting violence
- Impersonate any person or entity
- Post false, misleading, or deceptive content
- Spam, solicit, or send unsolicited commercial messages
- Collect or harvest information about other users without their consent
- Attempt to gain unauthorized access to accounts, systems, or data
- Interfere with or disrupt the Service or its infrastructure
- Use the Service for any commercial purpose without our prior written consent
- Use automated means to access or interact with the Service
- Circumvent any security measures or access restrictions
- Encourage or facilitate violations of these Terms by others
9. Content Moderation
Our Approach
BikeCrew strives to maintain a safe and respectful community. We use a combination of automated systems and human review to moderate content and enforce our policies.
- Chat messages may be monitored using automated AI-based moderation systems
- Images uploaded to BikeCrew may be automatically screened for inappropriate content
- We may review reported content and take action as we deem appropriate
Reporting
BikeCrew provides tools that allow users to report other users, content, or behavior they believe violates these Terms or our Community Guidelines.
You acknowledge and agree that:
- Reports may be reviewed and assessed at our discretion
- We may take actions we deem appropriate, including content removal, warnings, suspension, or account termination
- We are not obligated to monitor all user activity or review all reported content
- We do not guarantee that reported content or users will be reviewed or acted upon within any specific timeframe
- All moderation decisions are made at BikeCrew's sole discretion
No Duty to Monitor
The existence of moderation tools, reporting features, or content review processes does not create any obligation for BikeCrew to monitor user activity, review all content, or take any particular action in response to reports.
10. Subscriptions and Payments
Subscription Tiers
BikeCrew offers both free and paid subscription options. The paid "Pro" subscription provides access to additional features.
Billing
All subscriptions and in-app purchases are processed through the Apple App Store or Google Play Store, depending on your device. By subscribing, you agree to the payment terms presented at the time of purchase and the terms of service of the applicable app store.
- Payment will be charged to your app store account upon confirmation of purchase
- Subscriptions automatically renew unless cancelled before the renewal date
- You can manage or cancel your subscription through your device's app store settings
Refunds
Refund requests are handled by the Apple App Store or Google Play Store according to their respective policies. BikeCrew does not process refunds directly.
Price Changes
BikeCrew may change subscription prices at any time. In the case of unforeseen and cost-increasing circumstances, BikeCrew may also raise prices in the interim. Price changes will take effect at the start of your next subscription period following notice of the change. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.
11. Intellectual Property
BikeCrew's Intellectual Property
All intellectual property rights relating to the App, the Service, and all associated content — including but not limited to the software, source code, design, layout, graphics, logos, trademarks, text, algorithms, and other materials created by or on behalf of BikeCrew — remain the exclusive property of BikeCrew (TK Systems). This also applies where related development costs or expenses have been charged to the user.
You may not copy, reproduce, modify, distribute, display, create derivative works from, reverse engineer, decompile, or disassemble any part of the App or Service, unless expressly permitted by mandatory applicable law or with the prior written consent of BikeCrew.
User Content License
By posting User Content on BikeCrew, you grant BikeCrew a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, display, reproduce, modify, adapt, and distribute your User Content in connection with operating, promoting, and improving the Service. This license continues even after you delete your account, to the extent that your User Content has been shared with other users or incorporated into the Service.
12. Limitation of Liability
Disclaimer of Warranties
BikeCrew is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Any information provided through the Service is accurate, reliable, or complete
- Routes or suggestions are safe, legal, or appropriate
- The Service will meet your requirements or expectations
Limitation of Liability
12.1. To the maximum extent permitted by applicable law, BikeCrew provides the Service on an “as is” and “as available” basis and expressly disclaims all liability for any damages, losses, or claims arising out of or in connection with your use of, or inability to use, the Service. You acknowledge and agree that your use of the Service, and any activities arranged through the Service, are undertaken entirely at your own risk and responsibility.
12.2. BikeCrew acts solely as a neutral technology platform that enables users to connect. BikeCrew does not organize, control, supervise, endorse, or assume responsibility for any rides, meetings, events, or interactions between users, whether online or offline. All arrangements, decisions, and conduct are made solely by users.
12.3. Without limiting the generality of the foregoing, BikeCrew and its operator (TK Systems), affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Personal injury, death, accidents, collisions, or any physical harm occurring before, during, or after rides or meetups arranged via the Service
- Theft, loss of property, or damage to personal belongings
- Any misconduct, negligence, or unlawful acts by other users or third parties
- Loss of profits, data, revenue, or goodwill
- Any damages arising from your use of or inability to use the Service
- Damages resulting from incorrect, incomplete, or misleading information provided by you or other users
- Any interactions, agreements, disputes, or incidents between users, whether occurring online or offline
12.4. You are solely responsible for your own safety and conduct when using the Service and when participating in any ride or meetup. This includes, but is not limited to, complying with all applicable traffic laws and regulations, using appropriate safety equipment, assessing the suitability of other participants, and taking reasonable precautions at all times.
12.5. To the extent that any liability of BikeCrew cannot be excluded under applicable law, such liability shall be strictly limited to the minimum extent permitted. In such cases, the total aggregate liability of BikeCrew for any and all claims arising out of or related to the Service shall in no event exceed the total amount actually paid by you to BikeCrew (via the Apple App Store or Google Play Store) in the twelve (12) months immediately preceding the event giving rise to the claim. If you are using the free version of the Service and have not made any payments, BikeCrew's maximum aggregate liability shall not exceed zero euros (EUR 0.00).
12.6. If BikeCrew is covered by professional liability insurance, any liability shall be limited to the amount actually paid out by the insurer in the relevant case.
12.7. The limitations and exclusions of liability set out in this section shall apply regardless of the legal theory on which the claim is based (whether in contract, tort, negligence, strict liability, or otherwise).
12.8. Nothing in these Terms shall exclude or limit liability to the extent that such exclusion or limitation is not permitted under applicable law, including liability arising from wilful intent (opzet) or gross negligence (grove nalatigheid).
12.9. To the maximum extent permitted by law, BikeCrew owes no duty of care to users with respect to their interactions, activities, or conduct, whether online or offline.
Specific Disclaimers
BikeCrew is not responsible or liable for:
- The accuracy, safety, or legality of any routes displayed in the App
- Road conditions, closures, hazards, or changes
- Accidents, injuries, or deaths that occur during rides or meetups
- Property damage or theft
- Decisions you make based on routes or information in the App
- The actions, conduct, or behavior of other users, whether online or offline
- Events occurring during rides, meetups, or in-person interactions between users
- Any harm, injury, loss, or damages resulting from user interactions, even if a user was previously reported to BikeCrew
- Damages resulting from the use of third-party services, including the Apple App Store, Google Play Store, or any mapping or navigation services
No Assumption of Responsibility
The existence of moderation tools, reporting mechanisms, optional safety-related features, or community guidelines does not create any duty for BikeCrew to protect users from harm. You acknowledge that:
- BikeCrew does not verify user identities, backgrounds, or intentions
- BikeCrew does not perform background checks, identity verification, or screening of users
- BikeCrew does not supervise rides, meetups, or interactions between users
- You participate in rides and interact with other users entirely at your own risk
- You are solely responsible for your own safety and decisions
- BikeCrew makes no representations, warranties, or guarantees regarding the identity, intentions, legitimacy, or conduct of any user. Users may provide inaccurate, misleading, or false information, and may behave in an unsafe, unlawful, or harmful manner. BikeCrew shall not be responsible or liable for any acts or omissions of users, whether online or offline.
13. Indemnification
13.1. You agree to indemnify, defend, and hold harmless BikeCrew, TK Systems, and their officers, employees, agents, and successors from any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees and costs) arising from or related to:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any rights of another person or entity
- Your interactions with other users, whether online or offline
- Any third-party claims resulting from your use of the Service that cannot be attributed to BikeCrew
13.2. If third parties hold BikeCrew liable for damages resulting from your use of the Service, you shall support BikeCrew both judicially and extrajudicially, and shall immediately do everything that may reasonably be expected of you in that case.
13.3. If you fail to provide the support described in section 13.2, BikeCrew may take the actions it deems necessary to defend itself. All costs and damages incurred by BikeCrew in this respect shall be borne entirely by you.
14. Force Majeure
14.1. BikeCrew is not obliged to fulfil any obligation under these Terms if it is prevented from doing so by force majeure (overmacht).
14.2. Force majeure includes, but is not limited to: server or infrastructure failures, internet or telecommunications disruptions, cyberattacks, distributed denial-of-service (DDoS) attacks, power outages, natural disasters, pandemics, epidemics, government actions or restrictions, war, terrorism, civil unrest, strikes, supplier failures, and any other circumstances beyond BikeCrew's reasonable control.
14.3. BikeCrew may suspend its obligations under these Terms for as long as the force majeure continues. If the force majeure situation lasts longer than ninety (90) days, either party may terminate the agreement in writing without any obligation to pay compensation or damages.
14.4. If BikeCrew has already partially fulfilled its obligations before the force majeure event, or can only partially fulfil its obligations, BikeCrew is entitled to charge for the part already performed or performable, and this part shall be treated as a separate obligation.
15. Complaints
15.1. If you have a complaint about the Service, you must notify BikeCrew in writing (via email to info@bikecrew.app) within a reasonable period, but no later than one (1) month after discovering the issue.
15.2. A complaint does not suspend or cancel any payment obligation you may have.
15.3. If you do not notify BikeCrew of a complaint in a timely manner, you forfeit any right to recovery, replacement, or compensation in connection with that complaint.
15.4. If a complaint is found to be justified and was submitted in a timely manner, BikeCrew shall, within a reasonable period, take appropriate measures to address the complaint at its discretion.
15.5. If a complaint is found to be unjustified, any costs incurred by BikeCrew in investigating the complaint (such as research or investigation costs) may be charged to you.
16. Limitation Period
All claims and defences against BikeCrew, arising from or related to the use of the Service or these Terms, shall expire one (1) year after the event giving rise to the claim became known or should reasonably have become known to you. After the expiration of this period, your right to bring any such claim is forfeited.
17. Non-Disclosure
17.1. BikeCrew shall not disclose any of your personal information to third parties, except as described in our Privacy Policy, or where BikeCrew is required to do so by law, regulation, or court order.
17.2. BikeCrew shall not use any information obtained from you in a manner other than originally intended, except that such information may be used in legal proceedings involving BikeCrew where the information may be of relevance.
17.3. You shall not disclose the contents of any non-public agreements, communications, offers, or other expressions from BikeCrew to third parties, whether they are in writing or not, without the prior written consent of BikeCrew.
18. Termination
By You
You may delete your account at any time through the App settings. Upon deletion, your access to the Service will end, and your personal data will be handled according to our Privacy Policy.
By Us
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms or our Community Guidelines
- Conduct that we believe is harmful to other users, the community, or BikeCrew
- Extended periods of inactivity
- Requests from law enforcement or government agencies
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including but not limited to: intellectual property provisions (Section 11), limitation of liability (Section 12), indemnification (Section 13), the limitation period (Section 16), non-disclosure (Section 17), applicable law (Section 24), and competent court (Section 25).
19. Changes to the Service
We may modify, update, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
20. Changes to These Terms
We may update these Terms from time to time. When we make significant changes, we will notify you through the App or by other means. Your continued use of BikeCrew after changes become effective constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Service and delete your account.
You agree that the most recent version of these Terms and Conditions shall apply at all times. We encourage you to review these Terms periodically.
21. Third-Party Services
The Service may contain links to or integrations with third-party services, including but not limited to the Apple App Store, Google Play Store, mapping providers, and payment processors. BikeCrew is not responsible for the content, availability, privacy practices, or terms of any third-party services. Your use of third-party services is subject to their respective terms and conditions and privacy policies. BikeCrew makes no representations or warranties regarding third-party services.
22. Electronic Communications
By creating an account on BikeCrew, you consent to receiving electronic communications from BikeCrew, including but not limited to push notifications, in-app messages, and emails related to the Service. You can manage your communication preferences through the App settings or your device settings. Opting out of certain communications may affect your ability to use certain features of the Service.
23. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, Safety & Liability Disclaimer, and Community Guidelines, constitute the entire agreement between you and BikeCrew regarding your use of the Service and supersede all prior agreements, representations, and understandings.
Nullity
If any part of these Terms and Conditions is declared void, voidable, or otherwise unenforceable by a court of competent jurisdiction, this shall not affect the validity and enforceability of the remaining provisions. The invalid or unenforceable provision shall be replaced by a provision that most closely reflects the intent and economic effect of the original provision, to the extent permitted by law.
No Waiver
Our failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision or of the right to enforce it at a later time.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. BikeCrew may freely assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, corporate restructuring, or sale of assets.
Conflicting Provisions
In the event of any conflict between these Terms and Conditions and any other document or arrangement (other than a separate written agreement as described in Section 2), these Terms and Conditions shall prevail.
24. Applicable Law
These Terms and Conditions and any disputes arising out of or in connection with these Terms, including disputes about their existence and validity, shall be governed by and construed in accordance with the laws of the Netherlands (Dutch law), without regard to its conflict of law provisions.
If you are a consumer residing in the European Union, you shall also enjoy the protection afforded to you by mandatory provisions of the law of your country of residence.
25. Competent Court
All disputes arising out of or in connection with these Terms and Conditions shall be submitted exclusively to the Court of Limburg (Rechtbank Limburg), the Netherlands, unless mandatory consumer protection law prescribes a different competent court.
